Cultural Hunter Program Agreement

This Agreement has been concluded electronically through the approval of the individual wishing to participate in the Cultural Hunters Project, a sub-project of the Yücel Cultural Foundation, via the Foundation’s website.

The parties shall hereinafter be referred to as the “Cultural Hunter” and the “Foundation”.

1. Cultural Hunter Status
Individuals who become members of the Foundation’s website and make a donation in the amount determined by the Foundation shall be accepted into the Cultural Hunters Program with the status of “Cultural Hunter” and may benefit from the opportunities offered within the scope of the program. The Foundation reserves the right to reject applications when deemed necessary.

2. Right to Participate in Events
2.1. Cultural Hunters may participate in events announced within the scope of the Cultural Hunters Project (such as theatre, concerts, exhibitions, museums, screenings and similar cultural activities) with 50% of the ticket price covered by the Foundation. The Foundation procures the tickets from the institution organizing the event and pays 50% of the ticket price on behalf of the Cultural Hunter. The amount paid by the Cultural Hunter constitutes a participation contribution fee. The portion covered by the Foundation is considered a support provided to the Cultural Hunter.

2.2. Cultural Hunters may submit requests to the Foundation regarding sporting and cultural events they wish to attend. The Foundation evaluates such requests within the limits of its available resources.

3. Other Rights and Benefits
3.1. Cultural Hunters who complete emergency training programs designated by the Foundation may, if deemed appropriate, acquire the right to become an Event Leader. In such cases, they may attend the events in which they serve free of charge.

3.2. In order to participate in events, it is sufficient for the Cultural Hunter to use the “Join” button available on the Foundation’s website.

3.3. Cultural Hunters may write review or commentary articles regarding the events they attend in the “Genç Sayfa” section of the Foundation’s website.

3.4. Cultural Hunters may invite one person who is not a Cultural Hunter to attend an event by paying a contribution fee equal to 50% of the ticket price.

3.5. Cultural Hunters may participate in free events organized or announced by the Foundation; however, they may not invite a non-Cultural Hunter to such free events.

4. Obligations of the Cultural Hunter
4.1. Cultural Hunters are obliged to pay half of the participation fee for the event prior to the event.

4.2. Cultural Hunters must comply with the instructions of the Event Leader and the rules of the venue where the event takes place.

4.3. Photographs and video recordings may be taken during events by the Foundation or persons authorized by the Foundation. Images taken by the organizing institution and shared with the Foundation may also fall within this scope. The Cultural Hunter acknowledges and agrees that such images may include them and may be used by the Foundation for promotional and informational purposes.

The Cultural Hunter acknowledges that their contact information (phone number and email address) may be shared with the Event Leader for the purposes of event organization and coordination.

4.4. Cultural Hunters must be present at the venue at least 15 minutes before the event door opening time. Cultural Hunters who are not present 15 minutes before the event may not benefit from the event and may be considered absent.

4.5. Cultural Hunters must introduce themselves to the Event Leader carrying the Foundation’s flag or identifying sign.

5. Non-Attendance at Events
5.1. If a Cultural Hunter informs the Foundation at least 48 hours before the event that they cannot attend, the participation fee shall not be refunded; however, no additional sanction shall apply. The Foundation may allocate the vacant seat to another Cultural Hunter.

5.2. If the Cultural Hunter fails to attend the event without notifying the Foundation at least 48 hours in advance, the participation fee shall not be refunded and such conduct shall constitute a breach of the agreement. The Foundation reserves the right to terminate the Cultural Hunter status in such circumstances.

5.3. Individuals whose Cultural Hunter status is terminated due to non-attendance may regain the status by making a donation in the amount determined by the Foundation.

5.4. Individuals removed from the program by the Foundation due to violations of the agreement or program rules shall not be accepted again as Cultural Hunters.

6. Event Leadership
6.1. Cultural Hunters may become Event Leaders upon request and after completing a two-hour training program provided by the Foundation, subject to the Foundation’s approval.

6.2. Event Leaders may attend the events they lead free of charge.

6.3. Event Leaders shall receive an organizational contribution fee determined by the Foundation for each event in which they assume leadership responsibilities.

6.4. Event Leaders shall use personal data belonging to Cultural Hunters (including phone numbers, email addresses and similar contact information) shared with them solely for the purposes of organizing and coordinating the event. They may not use such data for other purposes, share it with third parties, or store it for any other purpose. Event Leaders accept that they shall bear all legal and administrative liability arising from any breach of this obligation.

7. Duties and Responsibilities of the Event Leader
7.1. The Foundation determines which events Event Leaders will be assigned to.

7.2. Duties of the Event Leader include:
a) Obtaining tickets from the address designated by the Foundation,
b) Being informed about the event they will lead,
c) Creating a WhatsApp group for participants of each event and responding to participant questions via the group,
d) Arriving at the event venue 30 minutes before the door opening time while carrying identifying signs of the Foundation and sharing the location via the WhatsApp group,
e) Providing an informational speech regarding the event, emergency procedures and the Foundation, distributing the tickets and collecting them after entry to be delivered to accounting,
f) Completing the printed event report form and delivering it together with the tickets to the Foundation.

7.3. The Foundation reserves the right to remove Event Leaders from their duties if they fail to fulfill their responsibilities properly.

8. Entry into Force
This Agreement shall enter into force on the date it is electronically approved by the Cultural Hunter.

9. Electronic Approval and Evidentiary Nature
9.1. The Cultural Hunter declares that they have read, understood and accepted all provisions of this Agreement by approving it electronically through the Foundation’s website.

9.2. The Cultural Hunter acknowledges that the date, time, IP address and user account information related to the electronic approval of this Agreement may be used as evidence where necessary.

10. Notifications
10.1. The parties agree that any notifications under this Agreement shall be made via the Cultural Hunter’s email address registered with the Foundation or through the Foundation’s official communication channels.

10.2. If the Cultural Hunter fails to notify the Foundation of changes to their contact information, notifications sent to previously provided contact details shall be deemed valid.

11. Amendments
11.1. The Foundation reserves the right to amend the provisions of this Agreement.

11.2. Any amendments shall enter into force on the date they are published on the Foundation’s website.

12. Governing Law and Jurisdiction
12.1. Turkish Law shall apply to the implementation of this Agreement.

12.2. Istanbul (European Side) Courts and Enforcement Offices shall have jurisdiction over disputes arising from this Agreement.
